THIS IS A LEGAL AGREEMENT BETWEEN YOU AND MACHINTEACH INC GOVERNS YOUR USE OF THE ALL MACHINTEACH PRODUCTS, SOFTWARE, SERVICES, AND WEBSITES (COLLECTIVELY REFERRED TO AS THE “SERVICE”). IT IS IMPORTANT THAT YOU READ AND UNDERSTAND THE FOLLOWING TERMS. BY CLICKING “AGREE,” YOU ARE AGREEING THAT THESE TERMS WILL APPLY IF YOU CHOOSE TO ACCESS OR USE THE SERVICE. MachinTeach ID - The login portal for iLearn, iGo, iTeach, Kelly, The Daily Lesson, and iBingo.
iLearn Terms - The self learning computer to give learners independent and complete access to The Daily Lesson, Kelly, and iBingo.
iGo Terms - The self learning phone to give learners independent and complete access to The Daily Lesson, Kelly, and iBingo.
iTeach Terms - The instant classroom creator to give educators access to The Daily Lesson, Kelly, and iBingo.
Kelly Terms - The automated instructor that lives natively on iLearn and iGo devices but is designed to be available on an any smart speaker.
The Daily Lesson Terms - The 18 level tech-enabled textbook series for life long learners to achieve all the major literacies in life.
iBingo Terms - permits learners to send in homework, do project, access academic checkpoints, and communicate with Kelly on non-MachinTeach devices.
Your MachinTeach.com account can be used as a single sign on to any of our products and we encourage you to use a single account instead of creating multiple accounts for different products in order to best serve your individual and unique learning needs across the MachinTeach suite of products. We encourage parents and guardians to customize unique access to MachinTeach learning tools based on the needs of each unique learner every day.
I. REQUIREMENTS FOR USE OF THE SERVICE
A. Age. The Service is designed for learners of all ages, and the safeties have been put in place to protect our younger or more vulnerable learners. This terms and service agreement is meant to grow and evolve with learners as they age and level up. For example, our default setting for 2-13 year old learner means that the device is uncontactable by any third party, including MachinTeach. Some features and content won’t be available until a learner becomes 13 years or older (or equivalent minimum age in the relevant jurisdiction), unless you are under 13 years old and your MachinTeach ID was provided to you as a result of a request by an approved educational institution or established as part of the portfolio and projects feature in iBingo by your parent or guardian. We do not knowingly collect, store, use or disclose personal information from any learner especially children under 13, or equivalent minimum age in the relevant jurisdiction, without verifiable parental consent. Parents and guardians take want to take the appropriate precautions to protect children, including monitoring their use of the service should review the privacy settings in two places - How to Monitor Your Learners MachinTeach ID and How to Monitor iBingo Shared Homework Settings.
To use MachinTeach, you cannot be a person barred from receiving the Service under the laws of the United States or other applicable jurisdictions, including the country in which you reside or from where you use the Service. By accepting this Agreement, you represent that you understand and agree to the foregoing.
B. Devices and Accounts. Full use of MachinTach may require purchasing compatible devices (fees do apply), Internet access, and certain software (fees may apply); may require periodic updates; and may be affected by the performance of these factors. MachinTeach reserves the right to limit the number of MachinTeach accounts ("Accounts") for any of its products that may be created from a device and the number of devices associated with an Account. The latest version of required software may be required for certain transactions or features. You agree that meeting these requirements is your responsibility.
C. Limitations on Use. You agree to your MachinTeach ID for the purposes permitted by this Agreement, and only to the extent permitted by any applicable law, regulation, or generally accepted practice in the applicable jurisdiction. This account allocates 1GB of storage capacity for learning artifacts, as described on MachinTeach product marketing websites. Additional storage is available for purchase, as described below. Exceeding any applicable or reasonable limitation of bandwidth, or storage capacity (for example, backup or email account space) is prohibited and may prevent you from backing up to MachinTeach learning history. If your use of the Service or other behavior intentionally or unintentionally threatens MachinTeach’s ability to provide the Service or other systems, MachinTeach shall be entitled to take all reasonable steps to protect the Service and MachinTeach’s systems, which may include suspension of your access to the Service. Repeated violations of the limitations may result in termination of your Account.
D. License. MachinTeach grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms and any other applicable terms and conditions. You acknowledge that MachinTeach may terminate this license at any time for any reason or no reason.
E. Ownership. MachinTeach and its licensors own all right, title, and interest in and to the Service, including all intellectual property rights such as patents, trademarks, copyrights, trade secrets, and any other proprietary rights. You acknowledge that you have no rights in or to the Service except as expressly granted in these Terms.
F. Prohibited Conduct. You agree that you will not use the Service to:
i. violate any applicable law or regulation;
ii. infringe on any third-party intellectual property rights;
iii. transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable;
iv. impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
v. interfere with or disrupt the Service or servers or networks connected to the Service;
vi. engage in any activity that interferes with or disrupts the Service (or the servers and networks which are connected to the Service);
vii. attempt to gain unauthorized access to the Service, other accounts, computer systems or networks connected to the Service, through hacking, password mining or any other means;
viii. obtain or attempt to obtain any materials or information through any means not intentionally made available through the Service;
ix. use any robot, spider, scraper or other automated means to access the Service for any purpose without MachinTeach's express written permission; or
x. transmit any viruses, worms, defects, Trojan horses or other items of a destructive nature.
G. User-Generated Content. The Service may allow you to submit, upload, publish or otherwise make available content, such as homework, projects, comments or other information ("User-Generated Content"). You acknowledge that you are solely responsible for your User-Generated Content and the consequences of submitting or publishing it. You retain all ownership rights in your User-Generated Content, but you grant MachinTeach a worldwide, non-exclusive, royalty-free, transferable license to use, copy, modify, create derivative works based on, distribute, publicly display, publicly perform, and otherwise exploit in any manner such User-Generated Content in all formats and distribution channels now known or hereafter devised (including in connection with the Service and MachinTeach's business and on third-party sites and services), without further notice to or consent from you, and without the requirement of payment to you or any other person or entity.
H. Fees. Some features of the Service may require payment of fees, such as subscription fees or fees for additional storage. You agree to pay all fees and charges incurred in connection with your Account, including any applicable taxes, in accordance with the billing terms in effect at the time the fee or charge becomes payable.
I. Payment. MachinTeach uses third-party payment processors to bill you through a payment account linked to your Account. The processing of payments will be subject to the terms, conditions and privacy policies of the payment processor in addition to these Terms. MachinTeach is not responsible for any errors by the payment processor.
J. Auto-Renewal. Your subscription may automatically renew at the end of each subscription period, and you authorize Mach
